HPD violation classes: A, B, C and what each means

HPD issues housing maintenance violations in three severity classes. Understanding them is the difference between a $10 fee and a code enforcement lawsuit.

Class A — Non-hazardous

Cosmetic or minor issues. Peeling paint (non-lead), missing labels, minor plaster damage. Cure period: 90 days. Civil penalty: $10 per violation, per day past cure date (capped).

Class B — Hazardous

More serious. Water damage, mice, missing window guards, unsafe wiring. Cure period: 30 days. Civil penalty: $25 per day past cure date, plus $25 per day if not corrected within 6 months.

Class C — Immediately Hazardous

Critical. Lead paint hazards in a unit with a child under 6, no heat/hot water, broken smoke detector, evidence of rats or roaches. Cure period: 24 hours (heat/water) or 21 days (others). Civil penalty: $50 per day, plus $125 per day if HPD has to make the repair.
